The GLP-1 Patent Race Is Bigger Than the Drug

The GLP-1 boom is creating opportunities far beyond today’s weight-loss medications. Companies are exploring new combinations and formulations—and seeking patents to protect those ideas.

For businesses entering this market, understanding those patents could be just as important as spotting the next opportunity.

New Treatments, New Patent Questions

On September 23, Artelo Biosciences announced a provisional patent application for an experimental treatment used alone or alongside GLP-1 drugs such as semaglutide, the active ingredient in Ozempic and Wegovy. The obesity research is still at the animal-study stage, and the filing is not a granted patent. But it offers a timely example of companies pursuing new inventions around existing treatments. At the same time, older patents are beginning to expire in certain markets.

Semaglutide’s compound patent expired in India in March 2026. Yet Novo Nordisk subsequently reported lawsuits alleging that competing oral versions infringed separate patents covering how the medicine was formulated. Novo Nordisk’s report.

An Expired Patent Doesn’t Mean a Clear Path

That illustrates a business lesson: one patent expiring doesn’t necessarily mean the path to market is clear.

A new formulation or combination may involve other patent rights. Even securing a patent for an improvement does not automatically give a company permission to use the underlying technology. That is why freedom to operate, or FTO, matters: it examines whether a planned product could infringe someone else’s patent rights. WIPO’s explanation.

For innovators and investors, this creates a need for better visibility before committing significant time and money.
